§ 52.073 INDUSTRIAL COST RECOVERY SYSTEM.
   (A)   At the time of enactment of this chapter or the date on which this chapter becomes effective, the village shall resolve to develop an industrial cost recovery system pursuant to the requirements of 40 C.F.R. §§ 35.928 and 35.929 at such a time that industrial discharges to the treatment works significantly influence the costs of any additional treatment works that may be needed.
   (B)   The volume of flow shall be a factor in determining an industrial user’s share in the industrial cost recovery system. In addition, other factors such as strength of wastes and delivery flow rate characteristics may be incorporated to ensure that all industrial users of the treatment works pay a proportionate distribution of the grant assistance allowable to industrial use.
