§ 94.004 PROCESSING OF PERMITS.
   (A)   Construction of a new driveway or reconstruction of a driveway connecting to a street shall be allowed only after a permit has been obtained from the Department of Public Works Supervisor. The construction or reconstruction of a driveway shall be as described in the permit and plans or drawings attached.
   (B)   Future changes in the use of property abutting a street, such as a change from residential to commercial use or a change in the type of commercial operation, may require changes in the number, design or location of driveways constructed after the effective date of these rules. The property owner, when there is such a change in use, shall obtain a new permit from the Department of Public Works Supervisor.
   (C)   In the case of commercial, industrial or other developments where driveway access or related activities may be complicated or where the available parking area on private property is limited, the Department of Public Works Supervisor may be contacted in the initial site planning stages before application for a permit. An approved preliminary site plan satisfactory to all parties then may be established early in the development process.

§ 94.005 ENFORCEMENT.
   (A)   If a person fails to comply with any provisions of a permit or fails to obtain an appropriate permit, the Department of Public Works Supervisor may halt such person’s activity for which a permit is required until adequate corrections have been made. Costs incurred by the Department of Public Works Supervisor in correcting failure to comply with the terms and conditions of a permit, failure to obtain a permit, or defective workmanship or materials shall be borne by the applicant or person undertaking the activity.
   (B)   The applicant or his or her representative shall perform all work and pay all costs in connection with permitted activities.

DRIVEWAY PERMITS
§ 94.020 APPLICATIONS.
   (A)   An application for a driveway permit shall be accepted from a property owner, governmental agency, lessee or a legally authorized agent.
   (B)   An application for a driveway permit shall be submitted in the manner prescribed on forms supplied by the Department of Public Works. The application shall contain or be accompanied by a certification of either legal ownership consisting of a deed or title commitment, or title policy issued by a title company, and any agency authorization. The application shall be accompanied by plans or drawings containing the information required by this chapter and shall include the applicable design features required by §§ 94.040 through 94.065.

§ 94.021 PLANS OR DRAWINGS.
   Copies of a driveway permit application shall be accompanied by plans or drawings clearly indicating the following features of the site and abutting street and such other details as the Department of Public Works may require:
   (A)   Existing street pavement, ditches, right-of-way and property lines, street appurtenances, utilities, medians, if existing, and dimensions thereof;
   (B)   For commercial driveways, buildings, both proposed and existing, and appurtenances and dimensions thereof, including a notation as to present use of the buildings and details of internal traffic circulation, parking and traffic signs;
   (C)   Design features in accordance with §§ 94.040 through 94.065 of driveways, tapers and right-turn lanes to be constructed, reconstructed, relocated, surfaced, resurfaced, operated, used or maintained, including the following dimensions and features:
      (1)   Widths of driveways;
      (2)   Radii of driveway returns and other points of curvature;
      (3)   Driveway grades or profile view of drive, when necessary;
      (4)   Angle of the driveway relative to the street centerline;
      (5)   Dimensions of traffic islands adjacent to the street; and
      (6)   Driveway surface material and traffic island surface material.
   (D)   Distance from each existing and proposed driveway on the site to:
      (1)   Nearest intersecting street, road or street;
      (2)   Nearest driveway on adjacent properties;
      (3)   Street, road or driveways opposite the site;
      (4)   Property lines and property lines extended to the street centerline; and
      (5)   Buildings and business appurtenances on the site.
   (E)   Features in addition to driveways to be constructed within the street right-of-way, including traffic control islands, curb, sidewalks and authorized traffic signs;
   (F)   Existing and proposed drainage structures and controls, to include:
      (1)   Size of drive culvert;
      (2)   Type of culvert;
      (3)   Type of culvert end treatment;
      (4)   Grade of culvert; and
      (5)   Direction of surface water flow on or from adjacent property.
   (G)   North directional arrow.

§ 94.022 SPECIFICATIONS AND DESIGN STANDARDS.
   The design, location, construction and operation of driveways and related construction within the street right-of-way shall meet requirements of the current Department of Public Works standard specifications for street construction and the design standards required by §§ 94.040 through 94.065. A deviation therefrom shall be consistent with current and projected traffic volumes on the street and the driveway, adjacent development, equivalence of materials and methods, and safety requirements of persons using the driveways and streets. The deviation shall be in writing authorized only by the Department of Public Works.
