§ 31.01 PLANNING COMMISSION.
   (A)   Generally. The Planning Commission is established in accordance with the provisions of Public Act 33 of 2008, being M.C.L.A. §§ 125.3801 et seq.
   (B)   Members. The Planning Commission shall consist of nine members, who shall be representative of important segments of the community such as the economic, governmental, educational and social development of the village in accordance with major interests that exist within the village such as recreation, education, public health, government, transportation, industry and commerce. Members shall be appointed by the Village President, subject to approval by a majority vote of the members of the Village Council elected and serving. All members of the Planning Commission shall serve without compensation and the members shall hold no other municipal office except that one member may be a member of the Zoning Board of Appeals. The term of each member shall be three years and shall expire on the first Monday in January on the third year succeeding his or her appointment, or until his or her successor takes office. Members may, upon written charges and after a public hearing, be removed by a majority vote of the Village Council for misfeasance, malfeasance, or nonfeasance in office.
   (C)   Rules of procedure. The Planning Commission shall annually at its January meeting select from among its members a chairperson and shall hold meetings at least once per month. A member of the Zoning Board of Appeals serving on the Planning Commission is not eligible to serve as chairperson. The Planning Commission shall adopt rules of procedure and shall keep its records as required by state law.
   (D)   Powers and duties. The Planning Commission shall have all of the powers and duties as provided by applicable state law, the zoning ordinance of the village, and other applicable village ordinances.
   (E)   Annual report. The Planning Commission shall submit an annual report to the Village Council concerning its operations, its membership composition, and the status of planning activities, including recommendations regarding actions by the Village Council related to planning and development.
   (F)   Employees, consultants. The Planning Commission may, within budgetary limitations, appoint such employees as it may deem necessary for its work, whose appointment, promotion, demotion and removal shall be subject to the same provisions of law as govern other corresponding civil employees of the village. The Planning Commission may also, within budgetary limitations, retain consultants to advise it with respect to any matters that are properly before the Planning Commission. The Planning Commission may appoint advisory committees whose members are not members of the Planning Commission.
   (G)   Conflict of interest. For purposes of this division, a conflict of interest is a direct personal or financial interest in a matter before the Planning Commission that is not generally shared by members of the community. Knowingly voting upon any matter in which a member has a conflict of interest shall constitute malfeasance in office.
