§ 35.04 STREET AND SANITATION NONREVERTING CAPITAL FUND.
   (A)   There is hereby created a cumulative capital improvement fund to be entitled Street and Sanitation Nonreverting Capital Fund.
   (B)   The Common Council directs that the proceeds from special services provided by the Street and Sanitation Departments and other special proceeds generated or created within the city Street and/or Sanitation Departments shall be deposited in the aforementioned cumulative capital improvement fund.
   (C)   The Street and Sanitation Departments shall include in each annual budget hereafter an item requesting appropriations, if any, from the cumulative capital improvement fund here established.
   (D)   Said funds may only be withdrawn from the capital fund here established if:
      (1)   Said withdrawal has been approved by a vote of the members of the Board of Public Works & Safety approving said expenditures; and
      (2)   Upon prior appropriation of said fund monies by the Common Council.
      (3)   Said funds may be used for the purchase or lease of equipment for use by the Street and/or Sanitation Departments.
   (E)   No funds from the Capital Fund, here created, may be used for wages, salaries, or the on-going operational expenses of the Street and/or Sanitation Departments of the city.
