(A) Beginning on April 1 of each year and ending on July 31 each year, smoking shall not be permitted on the grounds of West City Park, except that smoking will be permitted inside vehicles. A first violation shall be punishable by a fine not to exceed $50; a second offense shall be punishable by a fine not to exceed $100; and a third or subsequent offense is punishable by a fine not to exceed $200.
(B) Beginning on April 1 of each year and ending on July 31 each year, the possession or use of alcohol shall not be permitted on the grounds of West City Park. Violations shall result in the offender being asked to leave the park and, if the offender refuses, the Peru City Police are hereby authorized to escort the individual from the grounds of West City Park. The violator shall not return on that day. A first violation shall be punishable by a fine not to exceed $50; a second offense shall be punishable by a fine not to exceed $100; and a third or subsequent offense is punishable by a fine not to exceed $200.
