(A) (1) It shall be unlawful to operate a UTV on any city road, street, alley and thoroughfare in the city except as specifically authorized by this chapter. Any person who operates a UTV in violation of this chapter shall be subject to a penalty as set forth in § 77.99. Further, the provisions of this chapter, the regulation of UTVS and the individuals operating UTVS in the city shall be subject to the laws and regulations of the State of Indiana as they may be amended.
(2) A UTV shall only be operated by a licensed driver, with proof of such on their person while operating the UTV.
(a) Number and placement. The number of occupants on a UTV shall be limited to the number of people for whom factory seating is installed on the UTV and with a maximum of one person per seat. The operator and occupants shall be properly seated, at all times, and no part of the body of the operator or occupants shall extend outside the perimeter of the UTV while the UTV is in operation.
(b) Minor as operator. No person under the age of 18 may operate a UTV on city road, street, alley and thoroughfare in the city.
(c) Helmet requirement. Helmets are required for underage passengers pursuant to § 9-18.1-14-11. An individual less than 18 years of age who is riding in an off-road vehicle shall wear a helmet that meets the standards established by the United States Department of Transportation under 49 CFR 571.218 as in effect January 1, 1979.
(B) No UTV shall exceed the posted speed limit.
(C) The UTV operator and all passengers must utilize seatbelts whenever the UTV is on a city road, street, alley, or thoroughfare.
(D) UTVs shall be subject to § 151.066(U).
(E) Any UTV operated on a city road, street, alley and thoroughfare must be registered under the laws of the State of Indiana and meet all registration and licensing requirements of the State of Indiana. Proof of registration must be always kept with the UTV.
(F) No towing. No UTV shall be used to tow any type of trailer or other vehicle, or anything designed to be an extension of the UTV. In furtherance thereof, no UTV may be altered in any way to be in violation of state law or this subsection or used to pull, push, tow, attach or drag any trailer, cart seating apparatus, side car or any other accessory.
