§ 154.10 SETBACK REQUIREMENTS FOR NEW CONSTRUCTION ON DEMOLITION LOTS.
   (A)   This chapter pertains to parcels of land within the city limits of Peru, Indiana when the primary structure and/or accessory structure have been demolished due to unsafe building. This chapter includes, but is not limited to demolitions enforced by the City of Peru Building Department. Property owner may build new construction with the same setback requirements in place when original primary and/or accessory structures were built. New construction built within the regulations of this chapter shall be deemed to apply uniformly to each class or kind of structure or land use by City of Peru Zoning Administrator. New construction deemed not uniformed to each class or kind of structure is required to be submitted to City of Peru Zoning Board of Appeals as an appeal to Zoning Administrator's final decision. New construction shall not exceed a minimum setback, unless otherwise approved by the City of Peru Zoning Board of Appeals, of:
      (1)   Each side of a primary structure minimum setback of five feet.
      (2)   Front minimum setback of ten feet.
      (3)   Rear minimum setback of 20 feet.
   (B)   This chapter must comply with International Residential Code Section R302 Fire-Resistant Construction.
