§ 33.018 DRUG-FREE WORKPLACE AND ALCOHOL POLICY.
   (A)   The city prohibits employees from unlawfully manufacturing, distributing, dispensing, selling, transferring, using, or possessing any illegal controlled substance on the city’s premises or while working. Any employee who is found in violation of this policy will be subject to disciplinary action, up to and including termination.
   (B)   All employees are forbidden from using or possessing alcohol at any time on the city’s premises. In addition, employees shall not report to work while under the influence of alcohol. The only exception to the above policy is that employees may from time to time consume alcohol at city-related functions, including at receptions, dinners, and so on. In such cases, employees should consume alcohol in moderation, behave in a responsible manner, and represent the city well. Employees who abuse alcohol at work-related functions will be subject to disciplinary action, up to and including termination.
   (C)   If a department head or supervisor has reasonable suspicion to believe that an employee is under the influence of alcohol or illegal drugs, that supervisor has the authority to require the employee to submit to alcohol or drug testing immediately. The employee may be required to submit to alcohol testing via the data master machine or similar evidential breath testing device (EBT). An employee may choose to submit to a blood test instead. If an employee is believed to be under the influence of illegal drugs, the employee shall be required to submit to a blood or urine screen administered by a laboratory licensed and certified by the state of Indiana to do drug testing.
