3.04.1210: JUDGMENT FOR PLAINTIFF; CREDITS; REFUND:

   A.   If judgment is rendered for the plaintiff, the amount of the judgment shall first be credited as follows:

      1.   If the judgment is for a refund of sales taxes, it shall be credited on any sales or use tax or amount of use tax due from the plaintiff.

      2.   If the judgment is for a refund of use taxes, it shall be credited on any use tax or amount of use tax due from the plaintiff under Sections 3.04.250 through 3.04.390 of this Chapter.

   B.   The balance of the judgment shall be refunded to the plaintiff. (Ord. 106 §16(N), 1989)
