(a) Pursuant to its authority to monitor and maintain its sewer lines and facilities, the City may map the MS4, including MS4 outfalls and home sewage treatment systems; inspect storm water outfalls to the MS4; and take reasonable action to determine the sources of any dry-weather flows found as the result of these inspections.
(b) Inspection of Residential, Commercial, Industrial, or Institutional Facilities.
(1) Based on consent, administrative warrant, or other lawful warrant, the City may enter and inspect facilities to investigate possible violations of this chapter.
(2) Based on consent, administrative warrant, or other lawful warrant, facilities subject to this regulation may be required to permit installation of devices necessary to monitor and/or sample storm water discharge to investigate possible violations of this chapter. All devices used to measure storm water flow and quality shall be calibrated by the City to ensure their accuracy.
(3) It shall be a violation of this chapter to unreasonably delay, hinder, obstruct, prevent, or impede the City from conducting a full inspection and investigation otherwise permitted under the law.
(4) Nothing in this chapter shall be read to limit the City’s otherwise applicable powers to protect public health, safety and welfare, or to seek civil, criminal, or equitable relief otherwise available under the law.
