1275.01 ORGANIZATION, MEETINGS AND RULES.
   (a)   The Board of Zoning Appeals, which is created by the City Charter, shall annually elect one (1) of its members to serve as Chair and one (1) of its members to serve as Vice-Chair. The Board shall designate the Deputy Planning and Zoning Administrator as receiving clerk for matters sought to be brought to its attention.
   (b)   Meetings of the Board shall be scheduled at least monthly. There shall be a fixed place of meeting and all meetings shall be open to the public. A complete application must be delivered to the Planning and Zoning Office by 4:30 p.m. on the last Wednesday of the prior month. There is a submission fee associated with the application in an amount to be determined by City Council.

   (c)   The Board shall adopt its own rules of procedure, consistent with the provisions of the Charter and this Zoning Code, and a record shall be kept of its proceedings, showing the attendance of members, action of the Board and the vote of each member upon each question considered. The presence of three (3) members is necessary to constitute a quorum. The Board shall act by resolution in which a simple majority must concur. The Board may adopt, from time to time, such rules and regulations, consistent with the provisions of this Chapter, as may be deemed necessary to carry into effect the provisions of this Chapter.
   (d)   Any member who misses more than three (3) consecutive meetings or more than one-half (1/2) of the meetings in any calendar year shall be deemed to have vacated his or her position and shall be replaced.
   (e)   The Board shall consult with the Planning Commission and shall request recommendations from the Planning Commission on all matters of concern to the Comprehensive Plan of the City.
