(a) The Planning Commission in procedure for enactment of zoning legislation or regulations respecting the platting or subdivision of lands, may provide by ordinance for such public hearings and notices and for the form and manner of publications or delivery of notices as it deems necessary and in the public interest and as may be in conformity with the City Charter, regardless of the provisions of the statutes of the State of Ohio in regarding thereto.

(b) Applications shall be submitted to the Planning and Zoning Administrator at least thirty (30) days prior to transmittal to the Planning Commission. Upon receipt of an application for a Special Approval Use, an Open Space Plan, a Planned Unit Development, a single-family cluster approval or any other land use approval which requires a decision on discretional grounds, one (1) notice that a request has been received shall be published in a newspaper of general circulation in the City and shall be sent by mail or personal delivery to the owners of property for which approval is being considered, to all persons to whom real property is assessed within two hundred (200) feet of the boundary of the property in question and to the occupants of all structures within two hundred (200) feet, except that the notice shall be given at least fifteen (15) days before the application will be considered. If the name of the occupant is not known, the term “occupant” may be used in making notification. Notification need not be given to more than one (1) occupant of a structure, except that if a structure contains more than one (1) dwelling unit or spatial area owned or leased by different individuals, partnerships, businesses or organizations, one (1) occupant of each unit of spatial area shall receive notice.
