Surcharges for industrial wastes shall be as follows:
(a) In addition to the base sanitary sewage charges applicable pursuant to Section 1052.05, industries discharging pollutants to the wastewater treatment works of the City, whose average concentration, as defined in Section 1052.03, in one or more classifications exceeds in any billing quarter that concentration defined as normal in Section 1052.03, for the corresponding classification, shall be subject to a surcharge calculated as follows:
(1) Surcharges for each billing quarter during a calendar year shall be based upon the following data applicable for the previous calendar year:
B. Total debt service payments to the Ohio Water Development Authority (Ctd);
C. Total pounds of BOD received at the wastewater treatment plant (Bt);
D. Total pounds of suspended solids received at the wastewater treatment plant (St);
E. Total pounds of phosphorus (as P) received at the wastewater treatment plant (Pt). Data not available shall be estimated in the most practical manner possible.
F. Total pounds of COD received at the wastewater treatment plant (Ct).
(2) Surcharge per pound of BOD in excess of normal equals:

(6) Pounds of BOD per billing quarter subject to surcharge equals: (Average concentration of BOD, calculated pursuant to Section 1052.03, in milligrams per liter minus 200 milligrams per liter) times volume of wastewater discharged from the industry to the wastewater treatment works per billing quarter, in 1, 000 cubic feet times 0.0624. If average concentration of BOD is 200 milligrams per liter, or less, no surcharge for BOD shall apply.
(7) Pounds of suspended solids per billing quarter subject to surcharge equals: (Average concentration of suspended solids, calculated pursuant to Section 1052.03, in milligrams per liter minus 240 milligrams per liter) times volume of wastewater discharged from the industry to the wastewater treatment works per billing quarter, in 1,000 cubic feet times 0.0624. If average concentration of suspended solids is 240 milligrams per liter, or less, no surcharge for suspended solids shall apply.
(8) Pounds of phosphorus per billing quarter subject to surcharge equals: (Average concentration of phosphorus, calculated pursuant to Section 1052.03, in milligrams per liter minus twelve milligrams per liter) times volume of wastewater discharged from the industry to the wastewater treatment works per billing quarter, in 1,000 cubic feet times 0.0624. If average concentration of phosphorus is twelve milligrams per liter, or less, no surcharge for phosphorus shall apply.
(9) Pounds of COD per billing quarter subject to surcharge equals: (Average concentration of COD, calculated pursuant to Section 1052.03, in milligrams per liter, minus 1,000 milligrams per liter) times volume of wastewater discharged from the industry to the wastewater treatment works per billing quarter, in 1,000 cubic feet times 0.0624. If average concentration of COD is 1,000 milligrams per liter, or less, no surcharge for COD shall apply.
(10) Surcharge shall be calculated according to paragraph (a)(10)A. or (a)(10)B. hereof, determined at the sole option of the Service-Safety Director.
A. Surcharge equals: (Pounds of BOD calculated pursuant to paragraph (a)(6) hereof times (surcharge per pound calculated pursuant to paragraph (a)(2) hereof plus (pounds of suspended solids calculated pursuant to paragraph (a)(7) hereof) times (surcharge per pound calculated pursuant to paragraph (a)(3) hereof) plus (pounds of phosphorus calculated pursuant to paragraph (a)(8) hereof times (surcharge per pound calculated pursuant to paragraph (a)(4) hereof.
B. Surcharge equals: (Pounds of COD calculated pursuant to paragraph (a)(9) hereof) times (surcharge per pound calculated pursuant to paragraph (a)(5) hereof) plus (pounds of suspended solids calculated pursuant to paragraph (a)(7) hereof) times (surcharge per pound calculated pursuant to paragraph (a)(3) hereof) plus (pounds of phosphorus calculated pursuant to paragraph (a)(8) hereof) times (surcharge per pound calculated pursuant to paragraph (a)(4) hereof.
(11) Formulas as contained in this subsection shall be subject to adjustment as necessary, based upon annual audit of sewer revenue fund expenses.
(b) Surcharges may also be established for pollutants, other than those provided for in this section, which are permitted to be discharged to the wastewater treatment works by the City, after pretreatment or without pretreatment.
(c) Surcharges levied pursuant to this section shall be billed quarterly.
