(a) No person who is an occupant of any single residential, multiple residential, commercial or industrial real estate and no person who is the owner of any multiple residential, commercial or industrial real property or of an unoccupied or unimproved property, shall place yard waste on a public right-of-way abutting such real estate unless such bush is tied in bundles not exceeding four feet in length and sixty-five pounds in weight and affixed with an official City of Perrysburg yard waste sticker or placed in an official City of Perrysburg yard waste bag or is placed on the public right-of-way during such times as are publicly designated by the City, as City brush and leaf collection periods.
(b) If yard waste is placed in the public right-of-way when not tied in proper bundles with an official City of Perrysburg yard waste sticker or City yard waste bags or at times other than such times as are publicly designated as City brush and leaf collection periods, the City may cause such yard waste to be removed after giving the owner or occupant of the premises in question five days notice to remove the same. Upon such action, the City shall charge such occupant or owner charges as determined from time to time by Council pursuant to Section 660.14(c). Such charges are due and payable to the City by the owner or occupant upon presentation by the City for a bill for its services.
The remedy provided for in this subsection is in addition to the penalty provided in subsection (c) hereof. (Ord. 72-2006. Passed 3-21-06.)
(c) Whoever violates subsection (a) hereof is guilty of a minor misdemeanor. Punishment shall be as provided in Section 698.02. (Ord. 102-94. Passed 9-6-94.)
