(a) Except as provided in subsection (b) hereof, no person shall operate any fixed machinery or equipment, or similar mechanical device, in any manner so as to create any noise which would cause the noise level measured at the closest property line of the property generating the noise emission to exceed the applicable fixed noise level, as follows:

(b) The provisions of subsection (a) hereof do not apply to any standby equipment operated only in emergency situations.
(c) Whoever violates this section is guilty of a minor misdemeanor for a first offense and a misdemeanor of the fourth degree for any subsequent offense. Punishment shall be as provided in Section 698.02. (Ord. 77-83. Passed 9-20-83.)
