(a) In the event a properly placed mailbox is damaged as a result of the snow plowing activities of the Village, the property owner may call the Village and report same at 440-259-5004.
(b) The Public Works Department shall then, as soon as reasonably possible, cause said mailbox to be repaired or replaced in a manner that is fair, reasonable, necessary and appropriate.
(c) Replacements will be with a generic mailbox that is the same or reasonably similar to the damaged mailbox, and within the discretion of the Village of Perry Street Commissioner.
(d) Mailboxes that have been “knocked down” as a result of a Village snow plow throwing snow will be refastened if possible.
(e) Mailboxes that have been “knocked down” as a result of deteriorated materials are the responsibility of the owner, not the Village.
(f) Mailboxes that have been “knocked down” as a result of a Village snow plow making direct contact with the mailbox will be replaced by a mailbox that is the same or reasonably similar to the damaged mailbox, and within the discretion of the Village of Perry Street Commissioner.
(g) Mailboxes that had been originally placed, installed and/or constructed improperly are the responsibility of the owner and shall not be repaired or replaced by the Village.
(h) The Village shall not be responsible for the repair and/or replacement of any mailbox that had been originally placed, installed and/or constructed above the standard U.S. Postal mailbox permitted in the right-of-way; the repair and/or replacement of such will be the responsibility of the property owner, (a property owner may determine what the proper location of his/her mailbox is along the road way by contacting the Perry Village Postmaster.)
(i) Although decorative or expensive mailboxes are permitted within the Village, and may be required by individual homeowner associations, they are not required by the Village; the Village’s policy in the case of damage to such mailboxes by a Village snow plow is limited to repair of the existing mailbox, replacement with a generic mailbox, or a cash settlement in the amount of fifty dollars ($50.00).
(j) Mailbox repairs will occur as soon as reasonably possible; if a property owner chooses to repair/replace his/her mailbox before the snow removal is completed, the Village will reimburse him a cash settlement in the amount of fifty dollars ($50.00). (Note: A release form must be completed and signed by the owner prior to the reimbursement.)
