(a) All variances shall be approved by the Perry Village Planning Commission after review by the Village Council, the Village Engineer (and/or Sanitary Engineer where applicable).
(b) Petitioners asking for a variance shall file application forms (Appendix G) and must show the Commission the following:
(1) That unusual topographical or exceptional physical conditions exist.
(2) That strict compliance with these Regulations would create an extraordinary hardship, not solely financial.
(3) That the modification proposed is only to the extent necessary to negate the extraordinary hardship,
(4) That any modification granted will not be detrimental to the public interest nor in conflict with the intent and purpose of these Regulations. Additional conditions may be necessary to accomplish the purpose of these Regulations if modified by a variance.
