§ 41.065  UNLAWFUL MANUFACTURE, DISTRIBUTION, DISPENSATION, POSSESSION OR USE OF A CONTROLLED SUBSTANCE.
   (A)   Pursuant to the Drug Free Workplace Act being 41 U.S.C. §§ 701 et seq., the county is required to notify employees that the unlawful manufacture, distribution, dispensation, possession or use of a controlled substance in the workplace is prohibited, whether or not the employee is on duty. In addition, an employee who is convicted of a drug statute violation arising out of conduct occurring in the workplace must notify his or her department head (and if the violator is a department head, then he or she shall notify the Board of Commissioners of the county) no later than five days after the conviction. As a condition of employment, all employees must abide by these rules. Any employee who violates these rules will be subject to discipline up to and including termination.
   (B)   Employees should be aware that all county employees and their families can receive confidential counseling through Southern Hills Counseling Center, Inc. located in the Professional Building, Highway 66 in Tell City. Southern Hills offers short-term counseling as well as referral, when appropriate, to long term counseling or specialized counseling.    (C)   Any supervisory employee who learns of an employee’s violation of this policy, or of an employee’s conviction of a drug statute violation for conduct occurring in the workplace shall immediately notify the department head. Failure to notify the department head will subject the supervisory employee to appropriate discipline.
