6-18-9: HANDICAPPED PARKING; PENALTIES:
A.   It shall be unlawful for any person to place or park a motor vehicle in any parking space, wheelchair ramp, wheelchair unloading area or any portion thereof that is designated and posted as a reserved area for the parking of a motor vehicle operated by, or transporting a physically disabled person unless:
   1.   Such person has applied for and been issued a detachable insignia indicating physical disability under the provision of 47 Oklahoma Statutes section 15-112, and such insignia is displayed as provided in 47 Oklahoma Statutes section 15-112; (Ord. 380, 11-9-2010)
   2.   Such person has applied for and been issued a physically disabled special license plate pursuant to the provisions of 47 Oklahoma Statutes section 15-112, and such license plate is displayed pursuant to the provisions of the Oklahoma vehicle license and registration act; (Ord. 380, 11-9-2010; amd. 2012 Code)
   3.   Such person has been issued a disabled veterans license plate with the international accessibility symbol pursuant to 47 Oklahoma Statutes section 1135.2 and such license plate is displayed pursuant to the provisions of the Oklahoma vehicle license and registration act;
   4.   Such person has been issued and is properly displaying a disability sticker issued by the department of veterans affairs or a federal military base; or
   5.   Such person has been issued and is properly displaying a physically disabled placard or license plate issued by another state.
B.   Violation of the provisions of subsection A of this section shall result in a fine of up to one hundred dollars ($100.00), and in addition thereto, such person shall pay any and all reasonable and necessary charges incurred by the landowner or other person in having any motor vehicle removed from the property and stored.
C.   Any person cited for a first offense for a violation of subsection A of this section, who has displayed a placard which has expired, shall be entitled to dismissal of such charge and shall not be required to pay the fine or court costs if the person presents to the court within thirty (30) days of the issuance of the citation a notice from the department of public safety that the person has obtained a valid handicapped parking placard. D.   Any person who has not been issued a physically disabled parking placard pursuant to the provisions of 47 Oklahoma Statutes section 15-112, a physically disabled license plate issued pursuant to the provisions of 47 Oklahoma Statutes section 1135.1, a disabled veterans license plate pursuant to the provisions of 47 Oklahoma Statutes section 1135.2, a disability sticker issued by the department of veterans affairs or federal military base, or a physically disabled placard or license plate issued by another state, and uses a placard, sticker or license plate to park in a disabled parking place, is guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1-4-1 of this code. A person transporting a physically disabled person with an authorized placard, sticker or license plate, shall be excluded from the provisions of this section.
E.   Any person who has been issued a physically disabled parking placard pursuant to the provisions of 47 Oklahoma Statutes section 15-112, a physically disabled license plate issued pursuant to the provisions of 47 Oklahoma Statutes section 1135.1, or a disabled veterans license plate pursuant to the provisions of 47 Oklahoma Statutes section 1135.2, and knowingly allows the placard or license plate to be used by a person not issued the placard or license plate, is guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1-4-1 of this code.
F.   A person who knowingly makes a counterfeit physically disabled parking placard or physically disabled license plate is guilty of a misdemeanor and, upon conviction, shall be subject to penalty as provided in section 1-4-1 of this code for each counterfeit placard or license plate made by such person.
