4-3-5: CONTAINER REQUIREMENTS:
A.   Containers: The City may, at its discretion, furnish garbage containers which will dump automatically, for use on certain premises throughout the City. Such determination shall be made by the City Commission after inspection of the premises to be served, and shall be based upon the amount of garbage produced or accumulated on the premises, the convenience of the occupants of the premises, and convenience of collection of garbage from the premises by the City.
B.   Location Of Container; Anchoring: In all areas of the City where there are open, unobstructed, all weather alleys wide enough for garbage collection vehicles to travel with ease, such garbage containers shall, at all times, be kept and maintained at the alley lot line on the premises served so as to be immediately accessible to the collection vehicles. In all other areas of the City, such garbage containers shall, at all times, be kept and maintained within five feet (5') of the side or rear of the main structure or dwelling on the premises, or in an accessible location convenient to the garbage collector, to be determined by the City Commission.
C.   Lids Or Covers Of Garbage Containers: The lids or covers of all garbage containers, whether provided by the occupant or owner of the premises, or furnished and owned by the City as provided in subsection A of this section, shall at all times be kept fastened so that flies and other insects may not have access to the garbage contained therein, and such lids or covers shall be removed only while depositing garbage into the garbage container, or while emptying garbage therefrom.
D.   Duty To Maintain In Sanitary Condition: Garbage containers shall, at all times, be maintained in good condition. Any container that does not conform to the provisions of this chapter or that may have ragged or sharp edges, or any other defect liable to hamper or injure the person collecting the contents thereof, shall be promptly replaced upon five (5) days' written notice given by the City Commission to the person whose responsibility it is to provide such container. The City Commission shall have the authority to deny refuse collection services for failure to comply herewith.
E.   Container Placement And Removal: All garbage containers placed at curbside for collection shall be placed within five feet (5') from the back of curb or edge of paved or graveled surface not more than twelve (12) hours prior to the day of collection and shall be moved off of the right-of-way before the end of the day of collection.
