§ 50.03 APPROVAL OF CONTRACTOR.
   (A)   Application process. Any person, firm, or corporation desiring to collect garbage, rubbish, refuse, solid waste, or recyclables in the city shall make application to the City Manager. Each application shall be submitted to the City Manager and will be forwarded to the City Council for their review and approval. The application shall, at a minimum, contain the following:
      (1)   The name and address of the applicant;
      (2)   If the applicant is a corporation, names and addresses of each Director and officer and each stockholder of the corporation;
      (3)   A description of each piece of equipment to be used in the collection;
      (4)   A schedule of proposed pick-up dates;
      (5)   A list of rates to be charged for service, all such rates must be volume based rates in accordance with the container requirements set forth herein;
      (6)   The place to which refuse is to be hauled;
      (7)   The manner in which refuse is to be hauled;
      (8)   A description of the type of container to be used to receive and contain refuse between collections;
      (9)   The location of the principal site from which the applicant will conduct business, including address and legal description;
      (10)   Information concerning applicant’s experience in the collection, hauling, and disposal of refuse and solid waste;
      (11)   List of date, name, and place, if any, where applicant has ever had a license revoked or rejected by municipal, state, or federal authority;
      (12)   List dates and places, if any, where the applicant has been convicted for the violation of any law of the United States or of any state or for the violation of any municipal ordinance; and
      (13)   Names and addresses of at least three business references with brief statement of the nature and extent of the business relations.
   (B)   Performance bond requirement. Approved contractors shall provide the city with a performance bond in the penal sum of at least $6,000, conditioned that he or she will faithfully and continually provide the refuse and solid waste collection services specified in the agreement.
   (C)   License fees. A license fee of $50, plus $5 for each additional truck, shall be payable in advance at the time of issuance of a license.
   (D)   Additional requirements. All applicants shall have obtained all bonds and insurance required for such contractor by Otter Tail County and shall have obtained all permits and/or licenses required by the county or any other local, state, or federal agency permitting or licensing such operations.
