1268.03 NONCONFORMING STRUCTURE.
   (a)   No building or structure that does not conform with the requirements of this Zoning Code shall hereafter be extended, structurally altered or rebuilt, unless the building is changed to make the building more conforming with the Zoning Code.
 
   (b)   Nothing in this Zoning Code shall prevent the reconstruction, repairing, rebuilding, and continued use of any nonconforming building or structure damaged by fire, collapse, explosion, acts of God or other casualty, subsequent to the date of this Zoning Code, provided that not more than fifty percent (50%) of the value of the building or structure was lost in such damage event and provided such reconstruction or repair does not extend the nonconformity and further provided that such replacement or repair occurs within one (1) year of the date of damage. When more than fifty percent (50%) of the value of the structure is lost in such damage event, the structure and use shall not be reconstructed except in a manner conforming with this Zoning Code.
 
   (c)   Nothing in this section shall prevent routine repairs and maintenance or the strengthening or restoring to a safe condition of any building or part thereof declared to be unsafe by any lawful authority or officer.
 
   (d)   Notwithstanding division (a) of this section, a building which is nonconforming solely because of a nonconforming setback may be altered and/or expanded provided that such alteration and/or expansion does not increase the area of the nonconformity nor result in a greater nonconformity of setbacks.
