(a) Application. An application for approval of a final plat shall be submitted in writing to the Clerk of Council. The application shall include the original tracing of the final plat, the original tracing of the drawings for the required improvements, three black-on-white prints of each tracing, three sets of specifications and profiles and other maps, data and certificates as set forth in Section 1252.03.
The developer may obtain conditional approval of the plat and install the required improvements before applying for approval of the final plat, or, alternatively, he or she may apply for approval of the final plat and drawings and specifications of required improvements concurrently and furnish performance guarantees that he or she will install the improvements thereafter. And, if approved, the developer may construct parts of the improvements before approval of the final plat and furnish performance guarantees for the construction of the remaining improvements.
The developer may apply for final plat approval of only that section of an approved preliminary plan of a subdivision which he or she proposed to develop and/or record as the first stage. However, the preliminary approval of any section shall become null and void if an application for final approval of the plat is not submitted within one year after approval of the preliminary plan, unless an extension of time is granted by the City Planning Commission.
(b) Review by City Engineer. The Clerk of Council shall transmit three prints of each drawing and the specifications to the Engineer for determination if:
(1) The final plat conforms to the approved preliminary plans and any special conditions or modification stipulated, and mathematical data and computations are correct; and
(2) The designs and details of the required improvements as shown on the drawings, profiles and specifications are in conformance with any master plan for streets and utilities and the construction standards in effect in the City.
One copy of each set of prints and specifcations shall be returned to Council by its next regular meeting indicating the Engineer's determinations.
(c) Council Action on Final Plat. If the Engineer finds the final plat, drawings, profiles and specifications are satisfactory in regard to the aforesaid provisions, and if the subdivision complies with all other applicable provisions of these Subdivision and Land Development Regulations, Council shall approve it. Action shall be taken within sixty days after the meeting at which the application for approval and all required plats, maps and data were submitted to Council or within a mutually agreed upon extension; otherwise the plat shall be deemed to have been approved.
Council shall act upon the final plat, drawings, profiles and specifications, either separately or concurrently, but in no event shall it approve the final plat for recording until the improvements are constructed or their construction guaranteed.
(d) Form of Approval. The approval of the final plat shall be indicated by a certification to that effect on the original tracing of the plat with the signature of the Secretary of the Commission and the City Engineer. Such final plat shall also be approved by resolution of Council and such approval shall be endorsed thereon by the Clerk indicating the number of the resolution and the date of passage before approval by the City shall be effective. The Commission shall obtain one duplicate tracing thereof at the developer's expense before returning the tracing to him or her. The reason for disapproval of a plat shall be stated in the records of the Commission.
The approval of the drawings, profiles and specifications for the required improvements shall be indicated by a certificate to that effect on the original drawings and specifcations with the signature of the Engineer. Approval of the improvements as constructed shall likewise be certified by the Engineer.
(e) Recording. The developer shall file the approved final plat in the office of the County Recorder. Approval by the City shall expire within sixty days after the final action by Council unless within that period the plat shall have been duly filed and recorded and the Commission so notified by the developer. If the final plat is revised in any manner after approval, the approval shall be null and void.
(f) Effect of Approval and Recording. If drawings, profiles and specifications for improvements are approved, the construction of the same may be started. After satisfactory construction the final plat may be approved and recorded, building permits may be issued and lots may be sold, leased or transferred.
If drawings and specifications for improvements are approved and construction guaranteed, the final plat may be approved for record purposes only and recorded, construction of improvements may be started, building permits may be issued and lots may be sold, leased or transferred.
Occupancy permits for a building shall not be issued until streets and utilities are accepted by the City for public use.
