250.02 VACATIONS.
   The following regulations shall govern vacation leave for all employees of the City:
   (a)   Vacation leave is leave with pay granted to employees as a reward for satisfactory service and as an incentive for future service.
   (b)   Full-time employees are entitled to vacation leave with pay, full-time being considered employees who are regularly scheduled to work forty or more hours per week. Part-time employees working a regular established schedule of less than forty hours per week shall accumulate vacation leave during the year on the basis of one-fifth of a day for each forty hours of work. Seasonal employees shall not be entitled to vacation leave. Part-time firefighters do not work a regular established schedule and are not entitled to vacation leave.
   (c)   Employees shall earn vacation leave, to be taken during the calendar year after it is earned, as follows:
      (1)   From the date of employment to December 31 of the calendar year in which the employment commenced (“the Employment Year”) and to the end of the fifth (5th) calendar year of continuous employment after the Employment Year, one (1) day for each month worked up to a maximum of ten (10) days.
      (2)   From the end of the fifth (5th) calendar year to the end of the twelfth (12th) calendar year of continuous employment after the Employment Year, one and one-half (1 ½) days for each month worked up to a maximum of fifteen (15) days.
      (3)   From the end of the twelfth (12th) calendar year to the end of the eighteenth (18th) calendar year of continuous employment after the Employment Year, one and two-thirds (1 2/3) days for each month worked up to a maximum of twenty (20) days.
      (4)   From the end of the eighteenth (18th) calendar year of continuous employment after the Employment Year, two and one-half (2 ½) days for each month worked up to a maximum of twenty-five (25) days.
   (d)   Vacation leave cannot be accumulated and must be taken during the calendar year after the year in which it was earned. The Mayor may give written permission to carry over vacation leave because of scheduling or because work by the City makes it impractical for the employee to use all of their vacation time in that calendar year.
   (e)   Vacation pay shall be paid at the rate of pay in effect at the time the leave is taken.
   (f)   An employee who is discharged shall forfeit all unused vacation leave earned. An employee who dies, becomes permanently disabled or voluntarily terminates employment after giving thirty (30) days’ written notice shall receive payment for all unused vacation leave earned.
