1488.16 CONFORMANCE TO NATURAL GRADE.
   Unless otherwise permitted by the Architectural Board of Review pursuant to this section, every outside swimming pool shall be at or below the natural grade of the surrounding land and no part thereof, other than a diving board or similar equipment and the fence required in this chapter shall be higher than such grade. The Architectural Board of Review in order to minimize disturbing the natural topography of the land by grading and/or filling may permit a portion of a swimming pool to be above the natural grade provided no more than 50% of the perimeter of the pool is above the natural grade and no portion of the pool is greater than two feet above the natural grade. Adequate retaining structures approved by the Architectural Board of Review must be provided for the above ground portion of the pool.
