1044.02 REQUIREMENTS FOR NEW AND EXISTING BUILDINGS.
   (a)    New Construction. Any person seeking a building permit to construct any building, other than a single-family dwelling unit, when a mechanical waste water treatment plant is to be constructed to service the waste from such building, shall:
      (1)    Obtain written approval of the plans, specifications and discharge point from the Ohio Environmental Protection Agency.
      (2)    Place on file with the City Engineer a copy of the plans, specifications and written approval by the Ohio Environmental Protection Agency.
      (3)    Submit an executed copy of a contract between the owner of the real property upon which the building and waste water treatment plant are to be constructed, and a Class III licensed State of Ohio Waste Water Works Operator, providing for the maintenance and repair of such treatment plant until its use can be discontinued and until connection is made to the sanitary sewer system of the City.
      (4)    Enter into an agreement with the City providing for semi-monthly inspections of the waste water treatment plant by the Inspector designated for such purpose, unless the plant has a 30,000 gallon per day capacity or more, in which case inspection shall be weekly. The agreement shall be in such form as determined and approved by the Law Director. Inspection fees shall be provided therein in accordance with the fee schedule set forth in Section 1446.03 of the Building and Housing Code, which fees shall be paid annually in advance by the owner to the Treasurer.
   (b)    Existing Buildings. On or after January 1, 1973, any person owning or operating any building or structure, other than a single-family dwelling unit, wherein or whereon or in connection with which a mechanical waste water treatment plant is used to service such building or structure, shall:
      (1)    Obtain written approval of the plans, specifications and discharge point from the Ohio Environmental Protection Agency.
      (2)    Place on file with the City Engineer a copy of the plans, specifications and written approval by the Ohio Environmental Protection Agency.
      (3)    Submit an executed copy of a contract between the owner of the real property upon which the building and waste water treatment plant are to be constructed and a licensed Class III State of Ohio Waste Water Works Operator, providing for the maintenance and repair of the treatment plant until its use can be discontinued and until connection is made to the sanitary sewer system of the City.
      (4)    Enter into an agreement with the City as provided in paragraph (a)(4) hereof.
