Prior to the issuance of any permit for development involving any stormwater BMP, the applicant or owner of the site must execute a maintenance and repair easement agreement that shall be binding on all subsequent owners of land served by the stormwater BMP. The agreement shall provide for access to the BMP and the land it serves at reasonable times for periodic inspection by the city, or the city’s designee, and for regular or special assessments of property owners to ensure that the BMP is maintained in proper working condition to meet the city stormwater requirements. The easement agreement shall be recorded by the city at the expense of the permit holder or property owners.
