§ 90.030 EXCEPTIONS TO THIS SUBCHAPTER.
   (A)   This subchapter shall not apply to the following.
      (1)   The emission of sound for the purpose of alerting persons to the existence of an emergency. This is to include the public address systems.
      (2)   The emission of sound in the performance of emergency work.
      (3)   Rail and air transportation and public mass transportation vehicles.
      (4)   The emission of sound in the performance of military operations, exclusive of travel by individuals to or from military duty.
      (5)   The emission of sound from activities in the discharge of weapons, fireworks display, or parades permitted by the City Council.
      (6)   The emission of sound from activities where the state or federal agency has adopted a different standard or rules than that prescribed within this subchapter.
      (7)   The emission of sound during nonprofessional athletic and school events or practices.
      (8)   (a)   The emission of sound from on-site stationary trash compactors, municipal owned and operated or municipally contracted compacter trucks loading or unloading yard waste, recyclable material, and/or trash/garbage.
         (b)   In cases where the sound originates within 300 feet of a land zoned residential under the city code, this exemption shall only apply between the hours of 7:00 a.m. and 10:00 p.m.
      (9)   The emission of sound during the operation, maintenance, repair, and cleaning of public streets and facilities.
      (10)   The emission of sound during work performed by or for public utilities.
      (11)   Agricultural activities, exclusive of those involving the ownership or possession of animals or birds.
      (12)   The emission of sound by church carillons, bells, or chimes, be it electronic or mechanical.
      (13)   The emission of sound by snow removal equipment on public and private property.
      (14)   (a)   Reasonable sounds emanating from sanctioned sporting events conducted on the grounds of a city public or parochial school, or college or university campuses, within a sports stadium between the hours of 9:00 a.m. and 10:00 p.m. Sunday through Thursday, and 9:00 a.m. and 12:00 midnight on Friday and Saturday.
         (b)   For purposes of this section, SANCTIONED SPORTING EVENTS are described as competitive matches between teams from different institutions.
         (c)   Sanctioned sporting events includes one hour prior to the event and one-half hour after the event. Sports team practices and intramurals are not considered sanctioned sporting events under this division (A)(14).
   (B)   Although exempt from the maximum permissible sound levels of this subchapter, an outdoor services permit is required in all cases where sound equipment and sound amplifying equipment will be used outside of any premises; 11:00 p.m. is the time limit.
