This subchapter applies to the control of all noise originating within the limits of the city, except in the following cases:
(A) Where a state or federal agency has adopted a different standard or rule than prescribed within this subchapter, which preempts the regulation of noise from a particular source so as to render this subchapter inapplicable; and/or
(B) Where the City Council has granted a variance consistent with the provisions of this subchapter, where there is public acceptance of the activity producing a particular noise or noises, resulting in a finding by the Council that said noise is generally deemed acceptable by the community.
