For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates, or requires, a different meaning.
CITY. The City of Peosta, Iowa.
GARBAGE. All solid and semi-solid, putrescible animal and vegetable wastes resulting from the handling, preparing, cooking, storing, serving, and consuming of food or of material intended for use as food, and all offal, excluding useful industrial by-products, and shall include all such substances from all residences.
HAZARDOUS WASTE. Waste materials, including, but not limited to, poisons, pesticides, herbicides, acids, caustics, biohazardous waste, flammable or explosive materials, and similar harmful wastes which require special handling and which must be disposed of in such a manner as to conserve the environment and protect the public health and safety.
MIXED HOUSEHOLD WASTE. Solid waste which is not recyclable waste.
OWNER. In addition to the record titleholder, any person residing in, renting, leasing, occupying, operating, or transacting business in any premises and as between such parties, the duties, responsibilities, liabilities, and obligations hereafter imposed shall be joint and several.
PREMISES. A building or part of a building and its grounds.
RECYCLABLE WASTE. Clean and dry newspapers and inserts, magazines, mixed home and office paper, corrugated cardboard and brown paper grocery bags, aluminum and tin cans, plastic containers, jugs and bottles that have a #1 PET or a #2 HDPE in the recycling symbol, and other items as deemed necessary by the City Council.
REFUSE. Putrescible and nonputrescible wastes including, but not limited to, garbage, rubbish, and ashes.
RESIDENTIAL YARD AND GARDEN WASTE.
(1) Yard waste generated from households to only include the following: garden plants, grass clippings and leaves, twigs, tree branches, and shrubs.
(2) Tree branches shall be no longer than four feet in length, four inches in diameter and not to weigh more than 50 pounds.
(3) Tree stumps do not fall within this definition and shall not be accepted at the c’s compost site.
RUBBISH. Nonputrescible solid waste consisting of combustible and noncombustible wastes.
SOLID WASTE. Garbage, refuse, rubbish, and other similar discarded solid or semi-solid materials. SOLID WASTE does not include toxic and hazardous wastes as defined by the State Department of Natural Resources.
SOLID WASTE CONTAINER. A container for the storage of garbage or rubbish which is:
(1) Provided with a handle and tight fitting cover;
(2) Made of noncorrosive material;
(3) Watertight; and/or
(4) With a capacity of no more than 35 gallons.
