A. Any police officer extended an offer of employment and/or employed by the village who is required to have training required by the village board of police commissioners and the laws of the state of Illinois, which includes the expenses set out in subsection B of this section, shall execute a police training reimbursement agreement.
B. In the event a police officer's employment with the village is terminated at any time during the first thirty six (36) months of the officer's date of hire, by reason of termination by the village for just cause or by reason of the officer voluntarily leaving such employment, the officer shall reimburse the village for all expenditures incurred by the village in connection with officer's training, such as expenditures for police training institute tuition, uniforms, including bulletproof vest, mileage, candidate screening, and other expenses incurred in training. These expenses shall be set out on a police training reimbursement agreement.
C. The gross total of the training reimbursement cost as set out in any police training reimbursement agreement which was incurred by the village for training of the police officer will be reduced by any sum the village may receive in the future from any state agency or other third party as reimbursement for expenditures the village incurred as a result of providing the officer with the training contemplated herein, and the officer shall be obligated to reimburse the village the sum remaining after any third party reimbursement is applied.
D. Payment of any reimbursement obligation due the village by the officer shall be due and payable immediately, at the time of the officer's termination of employment with the village becomes effective.
E. The officer shall further agree to pay all reasonable costs incurred by the village in collecting any sums due and owing to the village, pursuant to any police training agreement, including reasonable attorney fees and costs and any other legal expenses.
F. The police training reimbursement agreement shall be, in the basic form, as exhibit A attached to the ordinance codified herein made a part of this section. (Ord. 2003-1216, 7-15-2003)
