ORDINANCE NO. 2024 - 1728
AN ORDINANCE AMENDING TITLE 7, CHAPTER 2 OF THE VILLAGE CODE OF THE VILLAGE OF PEORIA HEIGHTS TO REGULATE TEMPORARY DUMPSTERS
 
   WHEREAS, the Village of Peoria Heights has proposed amendments to the Village Code of the Village of Peoria Heights, which proposed amendments are hereinafter set forth; and
 
   WHEREAS, the Village Board finds that adoption of the proposed amendments would be in the best interests of the Village of Peoria Heights and its citizens; and
 
   WHEREAS, the Village through the exercise of its home rule powers has the authority to approve the amendments hereinafter set forth;
 
   BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PEORIA HEIGHTS, PEORIA COUNTY, ILLINOIS, THAT:
 
Section 1. A new Section 16 is hereby added to Title 7, Chapter 2 of the Village Code of the Village of Peoria Heights as follows:
 
7-2-16: TEMPORARY DUMPSTERS:
 
(A)   For purposes of this Section, Temporary Dumpster means a large container designed for the receiving, transporting and dumping of waste materials on a temporary basis during demolition or construction projects. The term "temporary dumpster" does not include garbage receptacles used for normal waste collection services provided by a licensed waste hauler on a regularly scheduled basis.
 
(B)   Temporary Dumpsters shall be allowed within the Village subject to the following:
 
i.   Temporary Dumpsters shall not be placed on Village-owned property or public right of way.
ii.   The property on which the temporary dumpster is placed shall be occupied by a principal building.
iii.   No litter, rubbish, debris, or construction materials may extend beyond the height and width of the temporary dumpster; all items must be contained within the temporary dumpster.
iv.   Temporary dumpsters shall only be allowed on paved surfaces.
v.   Temporary dumpsters shall only be allowed for a period not to exceed sixty (60) days in any one-year period. Upon written request from the property owner, the Chief of Police in his discretion may grant an extension if the property owner is diligently pursuing removal activities.
 
 
Section 2 . This Ordinance is hereby ordered to be published in pamphlet form by the Peoria Heights Village Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
 
Section 3 .  This Ordinance is in addition to all other ordinances on the subject and shall be construed therewith excepting as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.
 
Section 4 .  This Ordinance shall be in full force and effect from and after its passage, approval and ten (10) day period of publication in the manner provided by law.
 
   
   PASSED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF PEORIA HEIGHTS, PEORIA COUNTY, ILLINOIS, IN REGULAR AND PUBLIC SESSION AND APPROVED BY ITS PRESIDENT THIS 2 nd DAY OF APRIL, 2024.
