ORDINANCE NO. 2024 - 1722
AN ORDINANCE AMENDING TITLE 1, CHAPTER 8, ARTICLE F OF THE VILLAGE CODE OF THE VILLAGE OF PEORIA HEIGHTS PROVIDING FOR FIRE DEPARMENT PERSONNEL
 
WHEREAS, the Board of Trustees for the Village of Peoria Heights has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and that protect the public health, safety, and welfare of its citizens; and
 
WHEREAS, pursuant to 65 ILCS 5/11 et seq., the Village has the authority, inter alia, to establish a fire department and provide for fire protection within the corporate boundaries of the Village; and
 
WHEREAS, the President and the Village Board of Trustees has considered the matter and determined that the proposed amendment to the Village Code is in the best interest of the Village.
 
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PEORIA HEIGHTS, PEORIA COUNTY, ILLINOIS, THAT:
 
SECTION 1 . That the above recitations are found to be true and correct.
 
SECTION 2 . Article F is hereby amended to read as follows (additions are indicated by underline, deletions by strikeout):
 
1-8F-1: CHIEF OF THE FIRE DEPARTMENT:
 
A.   Office Established: There is hereby established the office of chief of the fire department.
 
B.   Appointment: The chief of the fire department shall be appointed by the Mayor, with the advice and consent of the board of trustees, to an indefinite term of office or to a term established in an employment agreement with the Village, but shall at all times be subject to termination by the board of trustees.
 
C.   Compensation: The compensation of the chief of the fire department shall be determined by the Mayor, consistent with the budget and appropriation approved by the board of trustees.
 
D.   Duties Generally: The chief of the fire department shall be the chief executive officer of the fire department, responsible for directing the operations and managing the affairs of the Peoria Heights Fire Department, subject to the supervision and direction of the Village Administrator. 
 
1-8F-2: FULL TIME MEMBERS OF THE DEPARTMENT:
 
There is hereby created the position of full-time firefighter, the number of whom shall be determined from time to time by the Village Board. They shall be appointed, retained, disciplined and discharged by the fire chief and board of fire and police commissioners in accordance with the procedures established by applicable statutory provisions.
 
1-8F-3: DEPARTMENT PERSONNEL:
 
A.   Part-time Firefighters. The Fire Department may employ part-time firefighters in such number as approved by the Village Board from time to time. Part-time fire-fighters shall be at-will, part-time employees of the Village and shall not be full-time members of the Peoria Heights Fire Department. Part-time firefighters shall be hired by the Village President, with the advice and consent of the Village Board, upon the recommendation of the Fire Chief.
 
Part-time firefighters shall be subject to operational command and control by the fire chief, and shall fulfill any firefighting and all additional duties or functions as may be assigned from time to time.
 
Part-time firefighters shall be paid at an hourly rate for time actually worked, at a rate determined from time to time by the Village Board.
 
B.   Paid-on-Call Firefighters. The Fire Department may employ paid-on-call firefighters in such number as approved by the Village Board from time to time. Paid on-call firefighters shall be appointed by the Village President, with the advice and consent of the Village Board, upon the recommendation of the Fire Chief.
 
Paid on call firefighters shall be subject to operational command and control by the fire chief..
 
Paid-on-Call firefighters shall receive pay for services rendered, as determined from time to time by the Village Board.
 
C.   Administrative Staff. The Fire Department may employ part-time administrative staff in such number as approved by the Village Board from time to time.  
 
D.   Operations. All department personnel as set forth in this Section 1-8F-3 shall be subject to all requirements and provisions set forth in the Village Employee Handbook, as amended from time to time.
 
E.   Training. All firefighting personnel shall have such qualifications and training as shall be required from time to time by the fire chief, in accordance with all applicable laws and regulations.
 
 
SECTION 3. This Ordinance is in addition to all other ordinances on the subject and shall be construed therewith excepting as to that part in direct conflict with any other ordinance, and in the event of such conflict, the provisions hereof shall govern.
 
SECTION 4 . This Ordinance is hereby ordered to be published in pamphlet form by the Peoria Heights Village Clerk and said Clerk is ordered to keep at least three (3) copies hereof available for public inspection in the future and in accordance with the Illinois Municipal Code.
 
SECTION 5 .  This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
