5-3-7: ENFORCEMENT:
   A.   The Village Chief of Police or his official designee and/or the Village Code Enforcement Officer may serve a written notification upon the owner, occupant or tenant who owns or resides in or upon any private property or building on private property within the Village, or any such agents of such owner, ordering the violation of this chapter to be corrected and abated within five (5) days from the time the notice is served. Said notice shall be given by personal service; by registered or certified mail addressed to the owner, tenant, occupant or person in control or residing in any single-family dwelling or townhouse, or the owner, tenant or occupant of a two-family or multiple-family dwelling of less than five (5) units, or the owner or manager of a multiple-family dwelling consisting of five (5) or more dwelling units or a commercial building agent or owner; or by posting a sign regarding the violation on the premises of the property in violation of this chapter. If the notice is served by posting, the sign shall conform to the requirements of section 5-1-6 of this title.
   B.   After the expiration of five (5) days from the service of the written notice, if the person, owner, tenant, occupant, firm, corporation or other entity who has been served with a notice to correct and abate the violation has failed, neglected or refused to comply with the directions of the notice, the Village, under the direction of the Village Chief of Police or his official designee and/or Village Code Enforcement Officer may issue a citation for the violation of this chapter, or abate or cause the abatement of the violation without further notice.
   C.   Nothing in this chapter shall preclude the Village Chief of Police or his official designee and/or Village Code Enforcement Officer from issuing a citation for any violation of this chapter without providing any prior notification. The Village may also obtain an injunction or other appropriate equitable relief through the County Circuit Court to prevent or remedy any violations of this chapter. (Ord. 2017-1519, 9-5-2017)
