311.05 MOVING STRUCTURES OVER STREETS.
   (a)   No person, firm, corporation or entity shall operate any vehicle upon the public streets, highways, bridges, and culverts within the Municipality which is to move a structure that exceeds the maximum width, height and length as provided by the Village of Peninsula ordinances and in particular Section 339.02 without first obtaining the following permits, approvals and bonds, to-wit:
      (1)   All necessary permits and/or approvals for state highways from the Ohio Director of Transportation.
      (2)   From the County Engineer all permits or approvals by the Summit County Engineer.
(3)   All necessary permits and/or approvals from the applicable utility companies in assurances that utility personnel will be present at the time of the move to perform any and all tasks required to prevent any damage to or interruption in utility services.
      (4)   Submission to the Police Department and Fire Department of a plan that shall include but not be limited to the following, to-wit:
         A.   Approval from the property owner where the subject structure is located to be moved.
         B.   A plot plan indicating the various roads that are to be used and roads to be used within the Village of Peninsula.
         C.   The types of vehicles that are to be used.
         D.   The height, length and width of the structure to be moved.
         E.   Estimated length of time on the public streets and highways within the Village of Peninsula.
         F.   Any requirements regarding any easements or approvals necessary from property owners.
         G.   Detailed description of any utilities that are to be moved or that will be impacted.
         H.   A list of any and all road signs that are required to be removed or affected by the proposed transit of the structure.
         I.   Submission of the total gross weight of the structure and the vehicles involved.
         J.   A plan for emergency back-up procedures in the event of a breakdown or casualty involving said move.
         K.   If the structure is to be ultimately located within the Village of Peninsula, submission of all applicable permits including zoning permit.
         L.   Submission of any and all trees, shrubbery, or other greenery or structures that will have to be removed or altered by virtue of the transit of this structure. Tree trimmers shall be approved by the Village.
         M.   Submission of a liability policy in the sum of $100,000/$300,000 protecting the Village of Peninsula and the applicant against any and all claims and liabilities that may arise as a result of the transit of said structure on the public streets and highways within the Village of Peninsula.
   (b)   The Police Department shall, upon the satisfactory submission of all data and an independent investigation, submit its written report to the Mayor.
   (c)   The Police Department shall be responsible for supervising traffic control during said move once a permit has been issued. Fees for traffic control shall be paid by the applicant at the prevailing hourly rate for the amount of time used by the applicant subject to a minimum flat rate.
   (d)   The applicant shall further post with the Village a cash or surety bond in the sum of twenty-five thousand dollars ($25,000) as and for any damages to the public streets and highways caused by said move in favor of the Village.
   (e)   Upon submission of all applicable data hereinbefore required, the Mayor shall then approve a permit for the moving of said structure and submit his approval to the Fiscal Officer. The applicant shall then deposit with the Fiscal Officer a fee of fifty dollars ($50.00).
   (f)   Whoever violates this section is guilty of a misdemeanor of the first degree.
   (g)   Nothing contained in this section shall in any way be deemed to alter, amend, or impose upon the applicant a requirement to secure duplicate permits as it relates to all highways which are a part of the State highway system but located within the Village of Peninsula as set forth in Ohio R.C. 4513.34.
