(a) The keeping of chickens shall be permitted in any residential district subject to the following regulations and conditions;
(1) Having more than one rooster/cockerel at one time is prohibited. For the purposes of this section, a rooster/cockerel shall be defined as a male chicken that is of sufficient age that its sex can be determined through visual observation without the aid of any devices or equipment.
(2) Chickens shall be kept for personal use only, except for the sale of eggs.
(3) Chickens are to be maintained in the rear or back yard of the property of the owner of the chickens. Chickens shall not be permitted to roam or "free-range" outside the property of the owner.
(4) Chicken coops shall be located in conformance with the requirements for accessory structures and shall be maintained in good repair and sanitary condition.
(5) Chicken feed shall be stored in reasonable, airtight predator proof containers.
(6) Chicken waste shall be cleaned regularly and disposed of so as not to create a nuisance to neighboring residents.
(b) Any person violating this section shall be guilty of a minor misdemeanor except if the offender has been convicted of a violation of this section within one-year of the date of the offense, the violation shall constitute a misdemeanor of the fourth degree.
