711.04 EXCESSIVE FALSE ALARMS.
   If the Clerk-Treasurer records eight or more false alarms from the alarm user’s protected premises within a permit year, the following procedure will be utilized, to-wit:
   (a)   The Clerk-Treasurer shall notify by certified mail any alarm user which has received five false alarms on its record within said permit year citing the location and date of each said false alarm. Said notice shall include a statement that an accumulation of eight false alarms within the permit year can be cause for revocation of permit.
   (b)   The Clerk-Treasurer shall notify the alarm user and the alarm business providing service or inspection to the user by certified mail of any permit revocation and direct that the user submit a report to the Clerk-Treasurer within ten days of receipt of the notice describing actions taken or to be taken to discover and eliminate the cause of the false alarms.
   (c)   If the alarm user submits a report as directed, the Clerk-Treasurer shall determine if the actions taken or to be taken will prevent the occurrence of false alarms; if he or she determines that the action will prevent the occurrence of false alarms, he or she shall notify the alarm user of the relevant alarm business in writing that the permit will not be revoked at that time and that if one more false alarm occurs within the permit year, the permit will be summarily revoked.
   (d)   If no report is submitted, or if the Clerk-Treasurer determines that the actions taken or to be taken will not prevent the occurrence of false alarms, he or she shall give notice by certified mail to the user that the permit will be revoked without further notice on the tenth day after the date of the notice if the user does not file within that period a written request for a hearing.
   (e)   If a hearing is requested, written notice of the time and place of the hearing shall be served on the user by the Clerk-Treasurer by certified mail at least ten days prior to the date set for the hearing.
   (f)   The hearing shall be before a committee formed by the Mayor and the Clerk- Treasurer, and the alarm user shall have the right to present written and oral evidence. If the committee determines that eight or more false alarms have occurred in a permit year, it shall issue written findings to the Mayor of the Village of Peninsula that user’s permit is revoked.
   (g)   An alarm user shall immediately discontinue use of the alarm system upon being notified by certified mail of the revocation of a permit.
   (h)   An alarm user whose permit has been revoked may apply for a revoked user’s permit as provided herein.
   (i)   A revoked user’s permit shall be obtained from the Clerk-Treasurer of the Village of Peninsula, Ohio, by updating his original application containing the information as provided herein, and paying a fee as follows:

Third and each additional revoked user’s permit in permit year

Each permit shall bear the same expiration date as the date of the user’s original permit. The permit shall be physically upon the premises which is using the alarm system and shall be available for inspection by the Peninsula Police Department.
   (j)   A twenty-five dollar ($25.00) charge will be charged in addition to the fee provided herein to an alarm user who is more than sixty days delinquent in renewing a permit.
   (k)   An alarm user which is a governmental political unit shall be subject to the provisions of this chapter; but a permit shall be issued without payment of a fee and shall not be subject to revocation, payment of additional fees, or the imposition of any penalty provided herein.
