(A) This Council will adhere to the provisions of IC 36-8-19-8.5. The proposed fund will not exceed $0.0333 on each $100 of assessed valuation. Said tax rate will be levied beginning with taxes due and payable in 2023 and thereafter, continuing until reduced or rescinded.
(B) Proof of publication of the public hearing held on March 8, 2022, and a certified copy of Ordinance 2022-13 shall be submitted to the Department of Local Government Finance of the State of Indiana as provided by law. This Fire Protection Territory Equipment Replacement Fund is subject to the approval of the Department of Local Government Finance.
(C) The Town of Pendleton is the Provider Unit of the South Madison Fire Protection Territory. The other participating units are Fall Creek Township and Green Township, both in Madison County. The Town of Pendleton, as Provider Unit, is authorized to establish this fund.
