§ 53.999 PENALTY.

   (A)   Whoever violates any provision of this chapter for which no specific penalty is otherwise provided, shall be subject to the provisions of § 10.99.

   (B)   (1)   Any person that has violated or continues to violate §§ 53.175 through 53.191 shall be liable to civil penalties to the fullest extent of the law, and shall be subject to a fine of not more than $2,500 per day, per violation for a first violation nor more than $7,500 per day, per violation for subsequent violations, in accordance with IC 36-1-3-8(a)(10)(B).

      (2)The authorized enforcement agency may recover all attorney's fees court costs, consultant costs and other expenses associated with enforcement of §§ 53.175 through 53.191 including sampling and monitoring expenses.
