§ 33.60 ESTABLISHMENT.
    (A)   It is hereby ordained by the Pendleton Town Council, that an Impact Fee Review Board is hereby established in the town for the purpose of conducting hearings and adjudicating disputes contemplated by I.C. 36-7-4-1338. Each party shall serve a one-year term on such Board.
   (B)   Pursuant to 36-74-1338(a), the Town Council President shall select members of the Impact Review Board to serve one-year terms on the Board and shall only be removable for cause.
   (C)   Pursuant to IC 36-74-1338(a)(2) in the event a member of the Impact Fee review Board must be replaced due to a conflict of interest, the Impact Fee Review Board shall notify the Town Council President of the need for such a replacement and the replacement shall be named by the Town Executive such that the resulting Impact Fee Review Board complies with the requirements of I.C. 36-7-4-1338.
   (D)   The Impact Review Board shall consist of the following:
      (1)   One member who is a real estate broker licensed in the State of Indiana;
      (2)   One member who is an engineer licensed in the State of Indiana; and
      (3)   One member who is a certified public accountant.
