§ 50.05 UTILITY DEPOSIT REFUNDS.
   (A)   Service deposits required by either the Municipal Gas Department, Municipal Water Department or Municipal Electrical Department shall be refunded to the customer or consumer upon the happening of one of the following:
      (1)   A utility customer or consumer has, for a period of not less than 12 consecutive months, kept his or her utility bills current and paid the same on or before the due date during the said period of time; or
      (2)   The said customer or consumer is moving to a new residence outside of the village and will not be served by any of the utilities of the said village, and the said customer’s or consumer’s utility bills, including all past, present or any contemplated future utility bills, are fully paid.
   (B)   Upon the happening of either of the foregoing, the said customer or consumer shall be entitled to a refund of his or her utility deposit, and the said refund will be of principal only; excluding any interest thereon during the period of time in which the same was possessed by the village.
