(A) It is recognized that from time to time it may be necessary for a merchant to increase the price of new merchandise while older or similar merchandise remains on the merchant's shelf, displayed and offered for sale at a marked or labeled price lower than the increased price of the new merchandise. In such circumstances the merchant may mark or label the new and previously unmarked and unlabeled merchandise at the increased price and place such new merchandise on display, provided the merchant notes both the old and the new price (or prices) legibly and distinctly at a place on or in close proximity to the shelf on which said merchandise is displayed.
(B) No product previously labeled or marked may be remarked in violation of § 114.27.
