§ 112.91 BASIS FOR INCREASE IN RATES.
   (A)   In considering any application to change rates by any grantees of current and future franchise service ordinances within the city for franchise activities not regulated by the Public Service Commission, the franchising authority may consider the following in determining the proper basis for the increases in rates:
      (1)   Cost of living increases as evidenced by the cost of living index for utilities published by the United States Department of Labor, or if the Department ceases to publish an index, by any successor regularly accepted and established federal index.
      (2)   The return on equity capital authorized by regulatory bodies for regulated utilities; the price- earnings ratios of regulated utilities; the grantee's cost of service, including any cost efficiencies by reason of economy of scale; and the predominant rates charged in other jurisdictions within grantee's Dade/Broward system.
   (B)   In the event the cost of living increase index is not available at the time that a requested rate increase is made, the most recently available figure shall be utilized for the purpose of establishing the revised rate.
