§ 52.37 EMERGENCY REMOVAL OF NEWSRACKS.
   Emergency removal: Where the installation, use, or maintenance of a newsrack poses an imminent danger to pedestrians or vehicles, becomes a health or safety hazard for pedestrians or vehicles, or otherwise unreasonably interferes with the safe use of any right-of-way or other public property, the City Manager, or his or her designee, may remove the newsrack and/or base immediately. Within five days of removal, the city shall notify the newsrack provider, in writing. The newsrack provider may reclaim the offending newsrack upon repayment of the reasonable costs associated with the removal and storage of same. The city is not responsible for any damage caused to a newsrack which it removes for being in violation of this subchapter. If the newsrack provider fails to reclaim the subject newsrack within 45 days after notice of removal, the newsrack may be disposed of by the city, in any manner which it deems appropriate.
