For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ACTIVE DROP EMPLOYEE. An employee who has entered into any city offered deferred retirement option plan but remains a full time employee of the city.
CERTIFIED FIREFIGHTERS. All regular full- time, permanent employees of the city Fire Department who are identified on the city’s employee classification plan as a certified firefighter.
CERTIFIED POLICE OFFICERS. All regular full-time, permanent employees of the city’s Police Department who are identified on the city’s employee classification plan as a certified police officer.
CITY. The City of Pembroke Pines, Florida.
COMMENCEMENT DATE. March 1, 1989, the date on which this program was originally established.
CONTINUOUS SERVICE. Uninterrupted service by an employee (expressed as years and completed months) from the date he/she last entered employment as an employee of the city until the date of his/her normal retirement date.
DISABILITY. An employee who is receiving, or applied to receive and who has not been denied disability pension benefits from the applicable city pension fund.
EFFECTIVE DATE. October 1, 1991, the date on which the program becomes effective.
EMPLOYEE. All regular, full-time, permanent general and utility employees, certified firefighters and police officers of the city, as set forth in the city’s Employee Classification Plan. For purposes of this program, the term EMPLOYEE shall be those general and utility employees, certified firefighters and police officers that work more than 30 hours per week, annually. Excluded by the above definition are seasonal, temporary, part-time and contractual employees of the city.
GENERAL AND UTILITY EMPLOYEES. All regular full-time, permanent general and utility employees of the city who are identified on the city’s employee classification plan as general or utility employees of the city.
MEMBER. An employee who fulfills the prescribed participation requirements of the program.
NORMAL RETIREMENT DATE. The first day of any month if coincident with, following with, or following the attainment of normal retirement age and completion of continuous service prescribed by the city pension plan which covers employee. Provided, however, if employee does not participate in a city pension plan, then and only then, the normal retirement date shall mean the first day of any month if coincident with, following with, or following the attainment of 55 years of age and ten years of continuous service to the city.
PROGRAM. The retiree health insurance program set forth herein.
SERVICE INCURRED DEATH OR TOTAL DISABILITY. Whenever any employee dies or is injured in the performance of his or her duties for the city and dies or is declared to be totally disabled by the Board of Trustees for the applicable city pension plan or, if the employee does not belong to a city pension plan, when a city appointed doctor declares the employee to be totally disabled. For the purposes of this subchapter, TOTAL DISABILITY, at a minimum, shall mean that the employee is prevented by reason of a medically determined physical or mental impairment from rendering useful and efficient service to the city, or any other employer, and is not capable of performing, with or without accommodation, all essential job functions of any position available with the city, or any other employer, and is likely to remain so disabled continuously and permanently.
SPOUSE. A lawfully wedded spouse of an employee, if any, on the employee’s normal retirement date.
