§ 32.052 ORGANIZATION OF BOARD.
   (A)   The City Commission may appoint, but is under no direct mandate to do so, a seven-member Code Enforcement Board and legal counsel for the Code Enforcement Board. Members of the Code Enforcement Board shall be residents of the city. Appointments shall be made in accordance with City Charter Section 4.09 on the basis of experience or interest in the fields of zoning and building control. The membership of the Code Enforcement Board shall, whenever possible, include an architect, a businessman, an engineer, a general contractor, a sub-contractor, and a realtor.
   (B)   The appointments and membership of the existing Code Enforcement Board shall continue in accordance with the allocated terms of office by resolutions adopted by the City Commission.
   (C)   As provided for in F.S. § 162.05, initial appointments to the Code Enforcement Board shall be as follows:
      (1)   Two members appointed for a term of one years;
      (2)   Three members appointed for a term of two years; and
      (3)   Two members appointed for a term of three years.
   (D)   Thereafter, all appointments shall be made for a term of three years. Any member may be reappointed for one successive term on approval of the city. Appointments to fill any vacancy on the Code Enforcement Board shall be for the remainder of the unexpired term of office if any member fails to attend two of three successive meetings without cause and without prior approval of the Chairman of the Code Enforcement Board, the Code Enforcement Board shall declare the member’s office vacant and the City Commission shall promptly fill the vacancy. The members of the Code Enforcement Board shall serve in accordance with the City Charter and Code of Ordinances of the city, and may be suspended and removed for cause as provided in the Charter and ordinances of the city providing for removal of members of city boards.
   (E)   The members of the Code Enforcement Board shall elect a Chairman from among its members. The presence of four or more members shall constitute a quorum of the Code Enforcement Board.
   (F)   The City Attorney shall either be counsel to the Code Enforcement Board or shall represent the city by presenting cases before the Board, but in no case shall the City Attorney serve in both capacities. (Ord 668, passed 10-5-83; Am. Ord. 1697, passed 9-7-11 )
