§ 32.006 ATTENDANCE REQUIREMENT FOR ADVISORY BOARD MEMBERS.
   (A)   It is the express purpose and intent of this City Commission pursuant to this section to impose an attendance requirement on all members of city boards not otherwise governed by Florida Statutes or the City Charter. For purposes of this section, an UNEXCUSED ABSENCE shall be defined as an absence where the absentee board member did not notify the City Clerk, or his or her designee, in advance of a meeting that they would not be able to attend the meeting. If an advisory board member notifies the City Clerk, or his or her designee, in advance of a meeting that they will not be in attendance, then the absence shall be excused by the board. Each advisory board shall, at each meeting, determine by majority vote whether a member's absence is excused or unexcused.
   (B)   By virtue of this section any member of a board who is convicted of a felony while a member of the board shall automatically forfeit their position. Board members may also be removed for failing to meet the following attendance requirements:
      (1)   For the following city non-quasi judicial advisory boards, a board member shall be automatically terminated if the board member has three unexcused absences during any one term of office:
         (a)   Consumer Affairs Advisory Board.
         (b)   Landscape Advisory Board.
         (c)   Charter School Advisory Board.
         (d)   Economic Development Board.
         (e)   Arts and Culture Advisory Board.
         (f)   River of Grass Cultural Arts Center Board.
         (g)   Education Advisory Board.
      (2)   Following the third unexcused absence, the secretary of the respective board shall advise the City Clerk of the board member's third unexcused absence. The City Clerk shall then advise the City Commission of the board member's termination. No further action by the City Commission is required in order for the board member's termination to become effective. As soon as possible following the receipt of the notification from the City Clerk that a vacancy exists on the respective board, the District Commissioner shall appoint an individual to serve the remaining term of the terminated board member.
      (3)   For the following city quasi-judicial advisory boards, a board member shall be automatically terminated if the board member has four unexcused absences during any one term of office:
         (a)   Planning and Zoning Board.
         (b)   Board of Adjustment.
      (4)   Following the fourth unexcused absence, the secretary of the respective board shall advise the City Clerk of the board member's fourth unexcused absence. The City Clerk shall then advise the City Commission of the board member's termination. No further action by the City Commission is required in order for the board member's termination to become effective. As soon as possible following the receipt of the notification from the City Clerk that a vacancy exists on the respective board, the District Commissioner shall appoint an individual to serve the remaining term of the terminated board member.
