§ 50.04 CONTIGUOUS LAND OWNED.
If the land to which the utility service is to be extended is contiguous to any part of the village, the owner must petition for annexation to the village and continue to exert all efforts to obtain annexation until such annexation is complete before the property is eligible for village electric, water, or sewer service. In this case, village utility service will not be extended until the annexation has been granted or until the annexation has been denied by the County Commissioners. If the owner has petitioned and the petition has been denied by the Commissioners before receiving utility service, the owner must enter into an agreement with the village that he or she will continue to exert all efforts to obtain annexation of his or her property, and further agree that if the owner sells his or her property or any part of it, that he or she will require a similar agreement from the purchaser and will place a covenant in the deed requiring the purchaser to exert all efforts for annexation of such property.
