170.10 PLATS IN UNINCORPORATED AREAS WITHIN TWO MILES OF THE CITY LIMITS.
Pursuant to Platting, Division and Subdivision of Land and Standards for Land Surveying (currently Chapters 354) of the Code of Iowa, all subdivisions located in the unincorporated areas of Mahaska County within two (2) miles of the Pella City limits, and all subdivisions located in the unincorporated areas of Marion County within one (1) mile of the Pella City limits are hereby declared to be subject to review and approval pursuant to this chapter (the "extraterritorial platting area").
1.   Sketch Plans. The provisions of this chapter shall apply to all preliminary plats within the extraterritorial platting area as they relate to Pre-application Conference and Sketch Plan submittal.
2.   Preliminary Plats. Whenever the developer of any tract or parcel of land within the extraterritorial platting area desires to make a subdivision, all the provisions of this chapter applicable to preliminary plats shall apply. The Commission and the City Council shall have the right to waive such requirements as are contained in this chapter to the end that the Commission and City Council are provided sufficient documentation to demonstrate that the proposed subdivision meets current zoning requirements, is designed to meet or exceed the design standards and standard specifications, and is consistent with the Comprehensive Plan.
3.   Construction Plans. The provisions of this chapter shall include submittal of construction plans for all subdivisions within the extraterritorial platting area.
4.   Final Plats. The provisions of this chapter shall apply to all final plats within the extraterritorial platting area. The purpose of this section is to facilitate the orderly processing of subdivision in unincorporated areas within the extraterritorial platting area and to avoid conflicting regulations while at the same time assuring that provisions are made for proper and orderly future growth of the City.
5.   Plats of Survey. The provisions of this chapter shall apply to a plats of survey within the extraterritorial platting area. The purpose of this section is to facilitate the orderly processing of plats of survey in unincorporated areas within the extraterritorial platting area and to avoid conflicting regulations while at the same time assuring that provisions are made for proper and orderly future growth of the City.
