170.12 PUBLIC IMPROVEMENTS AND BONDS.
1.   Required Public Improvements. Before the final plat of any area shall be accepted by the City Council and recorded, the Subdivider shall make and install the required public improvements described in Section 170.13. The Subdivider shall request the City Council to accept any required public improvements.
2.   Performance Bond. In lieu of making and installing the required public improvements and before the plat is accepted by the City Council, the Subdivider shall post a performance bond. The performance bond is subject to the approval of the City Attorney and Finance Director and will insure to the City that all the improvements will be completed by the Subdivider within one year after City Council acceptance of the plat. The City Council may grant a one-year extension for the installation of improvements but in no case shall more than one extension be granted. The amount of the bond shall not be less than the full amount of the estimated cost of all the improvements that had not been accepted by the City Council. The estimate shall be based on the subdivider engineer’s estimate, and subject to approval by the City Engineer. If the installation of improvements is not completed within the specified time, the City shall exercise the bond or any portion thereof to complete same.
3.   Extraterritorial Jurisdiction. For plats located in unincorporated areas of Mahaska County within two (2) miles of the Pella City limits, the requirements of Section 170.13 shall apply. For plats located in unincorporated areas of Marion County within one (1) mile of the Pella City limits, the requirements of Section 170.13 shall apply.

4.   Urban Renewal Project. For improvements in plats included within an urban renewal project area the requirements of Section 170.13 may, not apply, at the discretion of the City.
5.   Exemptions. Bonds shall not be required for sidewalks required under this chapter. Where the sidewalk improvements are not installed at the time the Final Plat is recorded, the City shall only issue a certificate of occupancy for a building when the sidewalk improvements on the property where the building is located are completed.
6.   Design and Construction Criteria. Except as listed under subsection 5, Exemptions, above, all public improvements, including those covered by a performance bond, shall meet the design and construction criteria listed in Section 170.13, prior to acceptance of the plat by the City Council.
